MUSLIM MINDANAO AUTONOMY ACT NO. 186

 

Begun and held at Cotabato City on Monday, the twenty-eight day of October, two thousand three.

 

AN ACT CREATING BARANGAY UPPER PUGAAN IN THE MUNICIPALITY OF DITSAAN- RAMAIN, PROVINCE OF LANAO DEL SUR, INTO A DISTINCT, SEPARATE AND INDEPENDENT BARANGAY, AND FOR OTHER PURPOSES.

Be it enacted by the Regional Legislative Assembly in session assembled:

Section 1. Sitio Upper Pugaan is hereby separated from its mother Barangay Maranao Timber and constituted into a distinct and independent barangay to be known as Barangay Upper Pugaan in the Municipality of Ditsaan-Ramain, Province of Lanao del Sur.

Sec. 2. Barangay Upper Pugaan, with a total land area of 350.0262 hectares shall be bounded by natural and duly designated boundaries more specifically described as follows:

Sec. 3. The corporate existence of the barangay shall commence upon the appointment of its punong barangay and majority of the members of the sangguniang barangay.

 

 

 

 

Sec. 4. The Mayor of the Municipality of Ditsaan-Ramain shall appoint the punong barangay and seven (7) members of the sangguniang barangay immediately after the ratification of this Act.

Sec. 5. The Commission on Elections (COMELEC) shall conduct and supervise the plebiscite for the purpose upon the request of the Municipal Mayor within ninety (90) days after the approval of this Act.

Sec. 6. This Barangay shall be entitled to an equitable share from the unexpended balance of IRA share from the mother barangay until its own annual allotment shall have been segregated and released by the national government.

Sec. 7. The Sangguniang Bayan of the Municipality of Ditsaan-Ramain shall appropriate funds for the holding of the plebiscite for the purpose.

Sec. 8. The creation of the Barangay shall take effect when approved by majority of the votes cast in the plebiscite called for the purpose in the affected areas.

Sec. 9. This Act shall take effect immediately after its approval.
