Resolution No. 6654             February 28, 2004
IN THE MATTER OF DEPUTIZING THE BARANGAY OFFICIALS AND BARANGAY TANODS OF ALL CITIES AND MUNICIPALITIES THROUGH THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT FOR PURPOSES OF IMPLEMENTING COMELEC RESOLUTION NO. 6520
Promulgated: 28 February 2004
WHEREAS, pursuant to the Constitution, the Omnibus Election Code and other election laws, the Commission on Elections may deputize law enforcement agencies and instrumentalities of the government and exercise direct supervision and control over such agencies required by law to perform duties relative to the conduct of elections;
WHEREAS, the campaign period for candidates running for national positions has already begun while the campaign period for candidates vying for local positions is about to begin;lawph!l.nê+
WHEREAS, on January 6, 2004, the Commission promulgated Resolution No. 6520 or: "Rules and Regulations implementing Act No. 9006 (The Fair Elections Act) in relation to the May 10, 2004 elections and subsequent elections."
WHEREAS, Section 11 (6), Section 31 and Section 44 of the aforementioned resolution provide the following:
SECTION 11. Prohibited Forms of Election Propaganda. - During the campaign period, it is unlawful:lawph!l.nê+

6. to post, display or exhibit any election campaign or propaganda material outside of authorized common poster areas in public places, or in private places without the consent of the owner thereof.

SECTION 31. Creation of task Force to Tear Down and Remove Unlawful Election Materials. - There is hereby created a task force to tear down and remove unlawful election materials, to be known as the Supervisory Task Force, composed of the election Officer as Chairman, the Station Commander of the PNP (Chief of Police) as Vice-Chairman, and a third member belonging to any of the deputized agencies of the Commission.
The Task Force shall have the following duties and functions:
To tear down and remove campaign propaganda materials posted in public places outside the common poster areas;
to tear down and remove illegal campaign materials whenever posted or displayed;lavvphil.ñet
to make a report of said activities done by them;
to monitor and watch out for persons posting or distributing said unlawful election paraphernalia and to arrest said persons caught in flagrante delicto.

SECTION 44. Election Offenses. - Any violation of RA 9006 and these rules shall constitute an election offense punishable under the first and second paragraphs of SECTION 264 of the Omnibus Election Code in addition to administrative liability whenever applicable. x x x
WHEREAS, to accomplish the aforementioned task, the Commission needs further support from the public, particularly from the non-partisan groups;
WHEREAS, the Commission has determined that the barangay officials and barangay tanods of all cities and municipalities, with the supervision of the Department of Interior and Local Government (DILG), would be valuable partners in implementing Resolution No. 6520, particularly with respect to provisions therein relative to the posting of campaign propaganda materials, with the end view of ensuring the holding of free, orderly, honest, peaceful and credible national and local elections on 10 May 2004;
NOW, THEREFORE, the Commission on Elections, by virtue of the powers vested in it by the Constitution, the Omnibus Election Code and other related election laws, has RESOLVED to DEPUTIZE, as it hereby DEPUTIZES, the Metro Manila Development Authority (MMDA) and the Department of Environment and Natural resources (DENR) to perform the following specific duties in relation to the conduct of the elections, to wit:
To tear down and remove campaign propaganda materials posted in public places outside the common poster areas;
to tear down and remove illegal campaign materials whenever posted or displayed;
to make a report of said activities done by them; and
to monitor and watch out for persons posting or distributing said unlawful election paraphernalia and to arrest said persons caught in flagrante delicto.
E F F E C T I V I T Y
This Resolution shall take effect immediately following its publication in at least two (2) daily newspapers of general circulation on the Philippines.
D I S S E M I N A T I O N
The Executive Director shall furnish all deputized officials and/or departments, offices, agencies, through their respective heads, copies of this resolution.
The Education and Information Department shall disseminate this resolution for the information of the public.
