RESOLUTION No. 3619
NUMBER AND ALLOCATION OF SEATS OF (1) MEMBERS, HOUSE OF REPRESENTATIVES; AND (2) ELECTIVE MEMBERS OF THE SANGGUNIANG PANLALAWIGAN FOR PURPOSES OF THE MAY 14, 2001 NATIONAL AND LOCAL ELECTIONS
WHEREAS, the number of Members of the House of Representatives to be elected is based on the number of legislative districts created by law;
WHEREAS, two hundred and nine (209) legislative districts have so far been created;
WHEREAS, Section 4 of Republic Act No. 6636 provides that the number of elective sangguniang panlalawigan members shall be based on the income classification of the province, that is, first and second class provinces shall each have ten (10) elective sangguniang panlalawigan members; third and fourth class provinces, eight (8); and fifth and sixth class provinces, six (6).
WHEREAS, under Section 3 of Republic Act No. 7166, the number of elective sangguniang panlalawigan members in provinces comprising:
a) two or more legislative districts shall be apportioned equitably by legislative districts and elected also by legislative districts; that if equal division is not possible, the remaining member or members is/are to be elected in the district or districts with the greater number of population or if they be the same, with the greater number of voters; that if a legislative district includes a city that does not vote in the election of provincial officials, the number of seats shall be allocated among the districts in proportion to the population of the constituencies voting for the sangguniang panlalawigan.
b) one legislative district shall be equitably apportioned between the two (2) provincial districts established by the Commission, to be elected by provincial districts;
WHEREAS, Republic Act No. 8553 provides that in provinces with more than five (5) legislative districts, each district shall have two (2) sangguniang panlalawigan members.
WHEREAS, the provinces of Cebu, Negros Occidental and Pangasinan have more than five (5) legislative districts;
WHEREAS, Memorandum Order No. 01-2001 dated January 16, 2001 of the Bureau of Local Government Finance provides that:
"the income classification of LGUs under Department (of Finance) Order No. 24-97 dated March 26, 1997 as implemented under the various Memorandum Circulars of this Bureau are hereby maintained until September 30, 2001";
WHEREAS, the National Statistics Office have not yet issued the result of the 2000 Census of Population at the municipal level;
WHEREAS, in view of the urgent need to readjust and reallocate the number of elective sangguniang panlalawigan members so as not to hamper the preparations for the May 14, 2001 national and local elections, the Commission has to readjust and reallocate the number of elective sangguniang panlalawigan members based on the income classification of Local Government Units (LGUs) under Department (of Finance) Order No. 24-97 dated March 26,1997 and the 1995 Census of Population;
NOW, THEREFORE, considering the above and the by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, Republic Act Nos. 6636, 7166, 8553 and other election laws, the Commission RESOLVES to fix the number and allocation of seats for:
1) Members of House of Representatives, and
2) Elective members of the sangguniang panlalawigan, in relation to the May 14, 2001 national and local elections a shown in Annex "A" and "B" hereof, respectively, which annexes shall form an integral part of this Resolution.
Let the Education and Information Department publish this Resolution in two (2) daily newspapers of general circulation in the Philippines, and to furnish copies thereof to all Regional Election Directors, Provincial Election Supervisors and Election Officers.
