An Act Creating a Barangay to be Known as Barangay Care in the City of Tarlac, Province of Tarlac

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Creation of Barangay Care. - There is hereby-created a barangay to be known as Barangay Care in the City of Tarlac, Province of Tarlac.

Section 2. Territorial Boundaries. - The territorial boundaries of Barangay Care shall be identified as follows:

Bounded on the Northeast (NE) and Southeast (SE), along fines 1 to 61, by Barangay Tibag (PB-03-000061);

On the Southeast (SE) and Southwest (SW), along lines 61 to 95, by Barangay Tibagan (PB-03-000061);

On the Southwest (SW) and Northwest (NW), along lines 95 to 106, by Tarlac City versus Municipality of San Jose, both in Tarlac;

On the Northwest (NW), along lines 106 to 108, by San Jose Cadastre (PB-03-000060);

On the Northeast (NE), along lines 108 to 114, by Tarlac City versus Municipality of San Jose, Tarlac;

On the North (N) and West (W), along lines 114 to 116, by San Jose Cadastre (PB-03-000060);

On the Northeast (NE) and Northwest (NW), along lines 116 to 143 to the point of beginning by Barangay Sapang Maragul(PB-03-000061), all of Tarlac City.1âwphi1

Section 3. Conduct and Supervision of Plebiscite. - The plebiscite conducted and supervised by the Commission on Elections (COMELEC) on March 14, 1993 pursuant to Provincial Ordinance No. 2, Series of 1991, dated September 5, 1991 of the Sangguniang Panlalawigan of the Province of Tarlac, which ratified the creation of Barangay Care, shall serve as substantial compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".

Section 4. Incumbent Barangay Officials. - The incumbent barangay officials of Barangay Care shall continue to hold office until such time that their successors have been duly elected and qualified.

Section 5. Public Infrastructure and Facilities. - All public infrastructure and facilities for public use existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new barangay.

Section 6. Internal Revenue Allotment Shares. - Barangay Care shall be entitled to Internal Revenue Allotment (IRA) shares pursuant to Section 285 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".

Section 7. Effectivity. - This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
