[ REPUBLIC ACT NO. 6449, June 17, 1972 ]

AN ACT AMENDING CERTAIN SECTIONS OF REPUBLIC ACT NUMBERED FORTY-SIX HUNDRED FORTY-FIVE, KNOWN AS THE CHARTER OF THE CITY OF OLONGAPO.

Be it enacted by the Senate and House of Representatives of the Philippines in  Congress assembled:

Section 1. Subparagraph (rr), Section seventeen of Republic Act Numbered Forty-six hundred forty-five is hereby repealed.

Section 2. Section one hundred eight of the same Act is amended to read as follows:

"Section 108. Ownership of waterworks, electric, light and power, and telephone systems, roads, streets, etc.—Any provision of law to the contrary notwithstanding, all existing waterworks, electric, light and power, and telephone systems, presently operated by the Municipality of Olongapo shall be owned by the city, and revenues therefrom shall accrue to the special fund of the city.1âшphi1

"Ownership of properties within the City of Olongapo of whatever nature and source transferred and/or turned over to the Philippine Government by the United States Government before, during and after the date of the turnover of the then community of Olongapo on December seven nineteen hundred and fifty-nine, except all lands of the! public domain, shall vest, on the city, and all existing municipal and provincial roads, streets, bridges, docks piers, wharves, machineries, equipments and other public works improvements shall be owned by the city, any provision of law to the contrary notwithstanding."

Section 3. The same Act is amended by inserting between sections one hundred eight and one hundred nine a new section to read as follows:

"Section 108-A. Disposition of lands of the public domain within the city.—The disposition of lands of the public domain within the city shall be in accordance with the provisions of Commonwealth Act Numbered One hundred and forty-one, as amended: Provided, That all incomes and receipts derived from such disposition shall accrue exclusively to the city as provided in this Act, with the exception of two per centum thereof, which shall be retained by, or turned over by the city to, the Director of Lands for the use of his office as operating expenses in the administration and disposition of such lands."

Section 4. This Act shall take effect upon its approval.
