REPUBLIC ACT No. 4201

AN ACT TO AMEND SECTION THREE OF COMMONWEALTH ACT NUMBERED ONE HUNDRED THREE AS AMENDED BY COMMONWEALTH ACT NUMBERED TWO HUNDRED FIFTY-FIVE, THREE HUNDRED FIFTY-FIVE AND FIVE HUNDRED FIFTY-NINE.

Section 1. Section 3 of Commonwealth Act Numbered one hundred three, as amended by Commonwealth Acts Numbered Two hundred fifty-five, Three hundred fifty-five and Five hundred fifty-nine, is hereby amended to read as follows:

"Sec. 3. The Clerk of the Court; Other Personnel. The presiding Judge of the Court shall appoint one clerk of court (Ex-officio sheriff) with a salary of twelve thousand pesos per annum whose qualifications shall be membership in the Philippine bar and actual practice of law in the Philippines for at least five years or having occupied during a like period within the Philippines, a position requiring admission to the practice of law in the Philippines as an indispensable requisite.

"There shall also be six senior deputy clerks of court at six thousand pesos per annum each whose qualifications is membership in the Philippine bar;

"There shall also be twelve deputy clerks at four thousand eight hundred pesos per annum each;

"There shall be one chief hearing examiner and one Assistant chief hearing examiner with a salary of twelve thousand pesos and eleven thousand four hundred pesos per annum, respectively, whose qualifications shall be those of provincial fiscals;

"There shall also be thirty hearing examiners whose salaries shall be as follows:

"(a) Five hearing examiners at ten thousand eight hundred pesos per annum each;

"(b) Five hearing examiners at ten thousand two hundred pesos per annum each;

"(c) Five hearing examiners at nine thousand six hundred pesos per annum each;

"(d) Five hearing examiners at nine thousand pesos per annum each;

"(e) Five hearing examiners at eight thousand four hundred pesos per annum each; and

"(f) Five hearing examiners at seven thousand two hundred pesos per annum each.

"The qualifications for appointment to the position of hearing examiners shall be the same as those prescribed for provincial fiscals except those for hearing examiners mentioned in paragraph (f) of this section which must be actual practice of law in the Philippines for at least three years or having occupied during a like period within the Philippines a position requiring admission to the practice of law in the Philippines as an indispensable requisite or members of the bar having in his credit continuous service with this court in any capacity, both for the period of at least two years.

"There shall be one chief prosecutor and one assistant chief prosecutor at eleven thousand four hundred pesos and ten thousand eight hundred pesos per annum, respectively, whose qualifications shall be those of provincial fiscals.

"There shall also be twenty-four court prosecutors whose salaries shall be shown as follows:

"(a) Four court prosecutors at ten thousand two hundred pesos per annum each;

"(b) Four court prosecutors at nine thousand six hundred pesos per annum each;

"(c) Four court prosecutors at nine thousand pesos per annum each;

"(d) Four court prosecutors at eight thousand four hundred pesos per annum each;

"(e) Four court prosecutors at seven thousand eight hundred pesos per annum each; and

"(f) Four court prosecutors at seven thousand two hundred pesos per annum each.

"The qualifications for appointment to the position of court prosecutors shall be the same as those prescribed for hearing examiners.

"There shall be one division chief and one assistant chief of the court stenographic reporters at seven thousand two hundred pesos and six thousand pesos per annum, respectively.

"There shall also be twenty senior stenographic reporters whose salaries shall be four thousand eight hundred pesos per annum each, whose qualifications shall be senior stenographer eligible.

"There shall also be thirty junior stenographic reporters whose salaries shall be three thousand nine hundred pesos per annum each, who must be junior stenographer eligible.

"All appointments by the presiding judge shall be subject to the approval of the Secretary of Justice.

"There shall be one administrative officer as division chief at seven thousand eight hundred pesos per annum.

"There shall be one Budget officer at six thousand pesos per annum;

"There shall be one personnel officer at six thousand pesos per annum;

"There shall be one cashier at five thousand four hundred pesos per annum;

"There shall be one budget examiner at three thousand seven hundred twenty pesos per annum;

"There shall be two translators II at four thousand two hundred pesos each per annum;

"There shall be five interpreters at three thousand seven hundred twenty pesos each per annum;

"There shall be one assistant cashier at three thousand seven hundred twenty pesos per annum;

"There shall be one assistant chief of personnel section at four thousand two hundred pesos per annum;

"There shall be one reference librarian at three thousand one hundred twenty pesos per annum;

"There shall be one record officer at four thousand two hundred pesos per annum;

"There shall be one accounting clerk at three thousand six hundred pesos per annum;

"There shall be one cash clerk at three thousand seven hundred twenty pesos per annum;

"There shall be one (clerk I) senior clerk at three thousand seven hundred twenty pesos per annum;

"There shall be nine clerks at three thousand pesos each per annum;

"There shall be two clerical aide at two thousand seven hundred pesos each per annum;

"There shall be one (storekeeper I) supply officer at three thousand six hundred pesos per annum;

"There shall be three bailiffs at two thousand five hundred eighty pesos each per annum;

"There shall be four security guards at two thousand five hundred eight pesos each per annum;

"There shall be one watchman at two thousand four hundred pesos per annum;

"There shall be one senior janitor with free quarters, light and water at two thousand four hundred pesos per annum; and

"There shall be eight janitors at two thousand four hundred pesos each per annum;

"There shall be one chief of the legal and research division at nine thousand six hundred pesos per annum; whose qualification shall be that of a fiscal;

"There shall be two legal officers at seven thousand two hundred pesos each per annum;

"There shall be two research attorneys at six thousand pesos each per annum;

"There shall be one chief of the reporters and publication section at six thousand six hundred pesos per annum;

"There shall be two proof readers at three thousand pesos each per annum;

"There shall be one mimeograph operator at two thousand seven hundred pesos per annum; and

"There shall be one messenger-clerk at two thousand one hundred sixty pesos per annum;

"Legal officers, research attorneys and the chief of the reporter and publication section must be members of the Philippine bar.

"There shall be one division chief and one assistant chief of the examining division at nine thousand pesos and seven thousand eight hundred pesos per annum, respectively;

"There shall be one division chief accountant at seven thousand two hundred pesos per annum;

"There shall be one senior corporation auditing examiner at seven thousand two hundred pesos per annum;

"There shall be one senior accountant at four thousand two hundred pesos per annum;

"There shall be four corporation auditing examiners at six thousand six hundred pesos per annum each;

"There shall be four corporation auditing examiners at six thousand pesos each per annum;

"There shall be one clerk-bookkeeper at three thousand six hundred pesos per annum;

"The presiding judge shall further appoint and fix the compensation of such other officers, employees and technical staff as may be necessary, subject to the Civil Service Law, and subject to the approval of the Secretary of Justice."

Section 2. Provisions of any law to the contrary notwithstanding, the incumbent clerk of court and all other above-mentioned Court personnel as presently constituted shall receive the salary raise provided for in this Act corresponding to their rank and seniority or experience in the practice of law in the said office without the necessity of a new appointment unless public service demands otherwise: Provided, That no one of those holding office as such on the passage of this Act shall, by reason thereof, be removed from office or demoted to a lower category or scale except where the incumbent personnel lacks the necessary qualifications provided in this Act, in which case he shall be reappointed to another available position where he may be qualified, or except for cause and upon compliance with the due process provided for by law.

Section 3. In addition to such sums as may be provided in the current Appropriation Act, there is hereby appropriated out of any funds in the National Treasury not otherwise appropriated, such sums as may be necessary to carry out the provisions of this Act.

Section 4. This Act shall take effect on July first, nineteen hundred and sixty-five.
