PRESIDENTIAL DECREE No. 494 June 28, 1974

AMENDING THE PROVISIONS OF PRESIDENTIAL DECREE NO. 147 REGARDING THE DISPOSAL OF UNSERVICEABLE EQUIPMENT AND PROPERTY OF THE BUREAU OF PUBLIC HIGHWAYS

WHEREAS, Presidential Decree No. 147 authorized the Commissioner of Public Highways to dispose of all unserviceable equipment and property of the Bureau of Public Highways;

WHEREAS, the Office of the Commissioner of Public Highways and the Bureau of Public Highways are now defunct and in their stead the Office of the Secretary of Public Highways and the Department of Public Highways have been created pursuant to Presidential Decree No. 458;

WHEREAS, by virtue of these changes in organizational setup, it is necessary to amend Presidential Decree No. 147 to make it conform with the organization, powers and functions of the newly created Department of Public Highways and to further promote a more expeditious procedure in disposing of unserviceable equipment and property of the said office;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers in me vested by the Constitution, do hereby decree and order:

Section 1. The provisions of Sections 1, 4, 6, and 7 of Presidential Decree No. 147, amending the provisions of Executive Order No. 37, series of 1954 and Executive Order No. 290, series of 1958, regarding the disposal of unserviceable equipment and property of the Bureau of Public Highways are hereby amended in order to make the following words and phrases read as follows: "Commissioner of Public Highways" as "Secretary of Public Highways"; "Bureau of Public Highways" as "Department of Public Highways."

Section 2. Section 2 of the same Decree is hereby amended to read as follows:

"Sec. 2. Disposal Committee. To effect the speedy disposal of all unserviceable equipment and property of the Bureau, a Disposal Committee is hereby created composed of representatives of the following offices:

a. Department of Public Highways Chairman

b. Bureau of Equipment (DPH) Member

c. Bureau of Supply Coordination Member

d. Commission on Audit Member

Section 3. Section 3 of the same Decree is hereby amended by deleting subparagraph (f) of the said section.

Section 4. All existing laws, rules and regulations inconsistent with this Decree are hereby repealed and/or modified accordingly.

Section 5. This Decree shall take effect immediately.
