PRESIDENTIAL DECREE No. 153 March 13, 1973

AMENDING SECTION 358 OF THE NATIONAL INTERNAL REVENUE CODE AS AMENDED BY REPUBLIC ACT NO. 6110 TO INSURE THE IMPLEMENTATION OF THE PROGRAMS INITIATED BY THE BUREAU OF INTERNAL REVENUE

WHEREAS, to attain the objectives for increased tax collections and effectively insure the implementation of its programs, the Bureau of Internal Revenue has initiated the setting up of permanent offices and thereby establish a permanent repository of the records of the Bureau of Internal Revenue.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, and General Order No. 1, dated September 22, 1972, as amended, do hereby declare and order that:

1. Section 358 of the National Internal Revenue Code, as amended by R.A. 6110, be amended to read as follows:

Section 358. Disposition of proceeds of certain taxes. One per cent of the proceeds from the percentage taxes provided in Title V shall accrue to a special fund which shall be disbursed for the effective implementation of the provisions of this Code, including research, of the purchase of necessary vehicles and equipment, confidential tax information; for services and maintenance, rental amortizations of buildings, construction and repair of national, regional and district offices. This amount shall be considered receipts automatically appropriated and shall be retained and disbursed by the Commissioner of Internal Revenue. The provisions of any law, rules or regulations to the contrary notwithstanding, any disbursement from this fund shall be accounted for solely on the certificate of the Commissioner of Internal Revenue. After deducting the special fund stated herein and the existing special allotments, the balance of the proceeds shall be disposed of in accordance with Presidential Decree No. 144, Series of 1973.

2. This amendment shall be effective only for a period of six years from July 1, 1973, unless extended.
