MALACAÑAN PALACE MANILA BY THE PRESIDENT OF THE PHILIPPINES [ Proclamation No. 583, May 8, 1959 ] EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 369, DATED FEBRUARY 27, 1931, WHICH ESTABLISHED THE AGUSAN-DAVAO-SURIGAO FOREST RESERVE, CERTAIN PARCELS OF LAND EMBRACED THEREIN, AND DECLARING THE SAME OPEN TO DISPOSITION UNDER THE PROVISIONS OF THE MINING ACT WHEREAS, the findings of the Director of Mines show certain parcels of land from the operation of Proclamation No. 369, dated February 27, 1931, which established the Davao-Agusan-Surigao Forest Reserve; WHEREAS, the findings of the Director of Mines show that the areas sought to be excluded from the Davao-Agusan-Surigao Forest Reserve appear to be highly mineralized; and WHEREAS, under the provisions of section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining, which after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation by the President with the concurrence of the Congress of the Philippines. NOW, THEREFORE, upon the recommendation of the Secretary of Agriculture and Natural Resources and pursuant to the provisions of section 14 of Commonwealth Act No. 137, otherwise known as the Mining Act, I, CARLOS P. GARCIA, President of the Philippines, do hereby exclude certain parcels of the public domain from the Agusan-Davao-Surigao Forest Reserve established under Proclamation No. 369, dated February 27, 1931, and declare the same open to disposition under the provisions of the Mining Act, which areas are particularly described to wit: 1. Beginning 1 at a point marked corner 1 of parcel 1 on attached plan, being N. 89° 59' W., 800.12 meters from a point which is N. 23° 20' W., 17,816 meters from triangulation station Matinao in Bislig, Surigao with latitude North 7° 59' 22.067' and longitude East 126° 19' 55.151" to corner 2; thence to corner 3, N. 89° 59' E., 799.97 meters; thence to corner 4, N. 44° 58' E., 2,149.09 meters; thence, to corner 5 East, 3,355.86 meters; thence to corner 6, S. 84° 31' E., 2,820.92 meters; thence to corner 7, south, 7,449.31 meters; thence to corner 8, east, 868.12 meters; thence to corner 9, south, 731.52 meters; thence to corner 10, S., 42° 30' W., 1,828.80 meters; thence to corner 11, south, 2,215.64 meters; thence to corner 12, west, 1,779.90 meters; thence to corner 13, S. 32° 05' W., 1,450 meters; thence to corner 14, south, 3,482 meters; thence to corner 15, west, 909.02 meters; thence to corner 16, south, 4,995.20 meters; thence to corner 17, west, 5,563 meters; thence to corner 18, north, 4,111.20 meters; thence to corner 19, east, 4,286 meters; thence to corner 20, north, 884 meters; thence to corner 21, west, 1,255.74 meters; thence to corner 22, north, 596.53 meters; thence to corner 23, N. 0° 08' E., 2,000.18 meters; thence to corner 24, north, 650 meters; thence to corner 25, N. 32° 00' E., 1,728.16 meters; thence to corner 26, west, 2,018.52 meters; thence to corner 27, N. 0° 09' W., 2,033.48 meters; thence to corner 28, west, 1,088.60 meters; thence to corner 29, north, 930.20 meters; thence to corner 30, west, 800 meters; thence to corner 31, north, 6,730.76 meters; thence to corner 1, S. 89° 59' E., 927.18 meters; containing an area approximately 14,364.5349 hectares. 2. Beginning at a point marked corner 1 of parcel 2 on attached plan, being west 600 meters from a point which is N. 52° 26' W., 6,673.36 meters from B.L.L.M. No. 1 in the municipality of Lingig, Surigao; to corner 2, west, 300, meters; thence to corner 3, north, 1,500 meters; thence to corner 4, east, 1,200 meters; thence to corner 5, south, 2,100 meters; thence to corner 6, west, 900 meters; thence to corner 1, north, 600 meters; containing an area approximately 234.0000 hectares. 3. Beginning at a point marked corner 1 of parcel 3 on attached plan, being N. 45° 00' E., 1,272.79 meters from a point which is N. 34° 04' E., 9,559.20 meters from the triangulation station Matinao in Bislig, Susrigao with latitude North 7° 59' 22.067" and longitude East 126° 19' 55.151"; to Corner 2, south, 900 meters; thence to corner 3, west, 25 meters; thence to corner 4, south, 2,613 meters;, thence to corner 5; west, 1,500 meters; thence to corner 6, north, 3,000 meters; thence to corner 7, east, 625 meters; thence to corner 8, north, 513 meters; thence to corner 1, east, 900 meters; containing an area approximately 497.1375 hectares. The cutting, removal, and utilization of timber and other forest products therefrom shall be in accordance with existing Forest and Internal Revenue, Laws and Regulations, and at any time the said area shall not be utilized for mining purposes, the same shall revert as part of the Davao-Agusan-Surigao Forest Reserve. This Proclamation shall take effect only upon the concurrence of the Congress of the Philippines.
