Proclamation No. 605

EXCLUDING FROM THE OPERATION OF EXECUTIVE ORDERS NOS. 35 AND 35, SERIES OF 1904 AND 1912, RESPECTIVELY, THE WHOLE ISLAND OF DARAB, PROVINCE OF PALAWAN, PHILIPPINES, AND DECLARING THE SAME OPEN FOR MINING PURPOSES.

Whereas a petition has been filed for the exclusion of the whole Island of Darab, Province of Palawan, Philippines, from the Culion Leper Colony Reservation established under Executive Orders Nos. 35 and 35, series of 1904 and 1912, respectively;

Whereas, according to the report of the Director of Mines, dated March 9, 1939, concurred in by the Secretary of Agriculture and Commerce, the whole Island of Darab now included within the Culion Leper Colony Reservation appears to be mineralized; and

Whereas, under the provisions of section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Law, lands within reservations for purposes other than mining, which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservation by the President of the Philippines only with the concurrence of the National Assembly;

Now, therefore, I, Manuel L. Quezon, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Executive Orders Nos. 35 and 35, series of 1904 and 1912, respectively the whole Island of Darab, situated in the Province of Palawan, Philippines, and declare the same open to mining location and lease under the provisions of the Mining Act.

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly duly adopted for the purpose.

In witness whereof, I have hereunto set my hand and caused the seal of the Commonwealth of the Philippines to be affixed.
