EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 472, SERIES OF 1932, AND ESTABLISHING AS CAPOOCAN FOREST RESERVE FOR FOREST PROTECTION AND TIMBER PRODUCTION, A PARCEL OF THE PUBLIC DOMAIN SITUATED IN THE MUNICIPALITY OF CAPOOCAN, PROVINCE OF LEYTE, ISLAND OF LEYTE.

Upon the recommendation of the Director of Forestry, approved by the Secretary of Agriculture and Commerce, I, Manuel L. Quezon, President of the Philippines, hereby exclude a parcel of public domain in Capoocan, Leyte, from the operation of the provisions of Proclamation Numbered Four hundred seventy-two, dated May seventeen, nineteen hundred and thirty-two, establishing a colony for agricultural school graduates situated in the municipalities of Ormoc and Capoocan, Province of Leyte, island of Leyte; and pursuant to the provisions of section eighteen hundred and twenty-six of Act Numbered Twenty-seven hundred and eleven, known as the Revised Administrative Code, I hereby establish same, for forest protection and timber production, as the Capoocan Forest Reserve and place it under the administration and control of the Bureau of Forestry, which shall have the authority to regulate the use and occupancy of this reserve and the cutting, collection and removal of timber and other forest products therein in accordance with the forest law and regulations.

I, therefore, withdraw from entry, sale or settlement, and hereby declare and proclaim to be the Capoocan Forest Reserve, subject to private rights, if any there be, that portion of the public domain situated in the municipality of Capoocan, Province of Leyte, Island of Leyte, and described on Bureau of Forestry Map No. F. R.—94 to wit:

Beginning at corner 1, an apitong tree, 50 cm. in diam., marked F./R. 414/11, which is on the east side of road; which is S. 12° E., about 3,060 meters to barrio Limon, municipality of Capoocan; thence following a road in a southeasterly direction about 140 meters to corner 2, an apitong tree, 30 em. in diam., marked F. R. 414/16, which is on the north side of a road; thence following the road in a general southeasterly direction, 580 meters to corner 3, an apitong tree, 30 cm. in diam., marked F. Corners 1 to 42 were marked with the official marking hatchet No. B. F. 323.

This forest reserve contains an area of 372 hectares.
