AMENDING MEMORANDUM ORDER NO. 200 CREATING AN INTER-AGENCY COMMITTEE TO STUDY AND COORDINATE THE IMPLEMENTATION OF THE PROPOSAL OF HOPEWELL HOLDINGS, LIMITED TO UNDERTAKE VARIOUS INFRASTRUCTURE PROJECTS

WHEREAS, it is the policy of government to encourage the private sector to participate in the provision if public infrastructure and utilities as part of the capital build up of the country;

WHEREAS, Hopewell Holdings, Limited submitted on 31 January 1994 its proposal for several large infrastructure Development Projects in Luzon;

WHEREAS, the scope of said proposal crosses departmental boundaries and responsibilities, thereby requiring a single body to coordinate with various government agencies involved from the study phase up to execution of projects;

WHEREAS, Memorandum Order No. 200 was issued on April 19, 1994 creating a Committee composed of representatives from the Departments of Public Works and Highways, Energy, Transportation and Communications, Coordinating Council for Philippine Assistance Program, National Economic Development Authority and the Flagship Committee to study the Hopewell proposal;

WHEREAS, there is a need to accelerate the implementation of the various infrastructure projects proposed by Hopewell Holdings, Limited for BOT undertakings;

NOW, THEREFORE, I, FIDEL V. RAMOS, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby amend Memorandum Order No. 200, Series of 1994, to read as follows:

Section 1. Organization. – There is hereby created an Inter-Agency Committee to study the proposals of Hopewell Holdings, Limited to undertake various infrastructure projects and to coordinate the execution of approved projects composed:

Chairman Secretary of Public Works and Highways
Vice Chairman General Manager of the Philippine Ports Authority
Members Department of Transportation and Communications
Department of Energy
Department of Trade and Industry
Coordinating Council for the Philippine Assistance Program
Presidential Committee on Flagship Programs and Projects
Philippine National Construction Corporation
Local Government Units Concerned

Section 2. Duties and Responsibilities. – The Committee shall have the following duties and responsibilities:

a. To submit to the Office of the President its final evaluation and recommendation on the proposals of Hopewell Holdings, Limited to undertake various infrastructure projects;

b. To coordinate with the concerned national government agencies, local government units and non-governmental organizations on all matters concerning the proposal, from the study phase up to and including all stages of execution;

c. To recommend to the President appropriate action necessary for the implementation of the results of the study and of project execution; and

d. To include among its recommendations the feasibility of undertaking the Quezon Canal Project.

Section 3. Technical and Administrative Support. – The Committee shall organize its own Secretariat, the composition of which shall be drawn from the member agencies.

Section 4. Submission of Reports. – The Committee shall submit its regular reports to the President not later than the fifth day of each month.

Section 5. Repeal. – This Memorandum Order supersedes Memorandum Order No. 200, dated 19 April 1994.1aшphi1

Section 6. Effectivity. – This Memorandum Order shall take effect immediately.”
